The Designated Materials Regulation requires all brand owners to register with Recycle NB. Use the flowchart below to determine if you are a brand owner. There is no registration fee.
The definition of a brand owner is found in Section 2 of the Designated Materials Regulation. It is summarized in the flowchart below. If you determine that you are a brand owner and, therefore, obligated under the Regulation, please ensure you are registered with Recycle NB.
The deadline for brand owners to register with Recycle NB is February 21, 2016.
If you are a brand owner, you must register with Recycle NB. A brand owner with respect to an electronic product sold, offered for sale or otherwise distributed in or into the Province, is a person who:
(i) is a manufacturer of electronic products,
(ii) is a distributor of electronic products,
(iii) is an owner or licensee of a registered or unregistered trademark under which electronic products are sold, offered for sale or distributed, or
(iv) if an electronic product is imported into the Province, is the first person to sell the electronic product.
When displaying the total price of an electronic product on an advertisement or receipt of sale, the EHF must be included in the total price. (You can find examples of this in the Fee Display and Advertising page). This is a regulatory requirement and failure to do so is considered a violation of the Designated Materials Regulation.
It is possible that your company is not considered a Brand Owner under the regulations, but does sell regulated electronics. If this is the case, and your company is charging customers the Environmental Handling Fee, you must comply with Section 50.44 of the Designated Materials Regulation. (i) is a manufacturer of electronic products,
(ii) is a distributor of electronic products,
(iii) is an owner or licensee of a registered or unregistered trademark under which electronic products are sold, offered for sale or distributed, or
(iv) if an electronic product is imported into the Province, is the first person to sell the electronic product.
EPRA (The Electronic Products Recycling Association)is an industry-led, not-for-profit organization that operates regulated recycling programs in nine provinces across Canada. EPRA works on behalf of all stewards (Brand Owners) to operate recycling programs for end-of-life electronics that are designated under provincial EPR legislation. Electronics industry brand owners selected EPRA to be their designated Agent to fulfill their obligations under the Designated Materials Regulation. EPRA manages and operates the electronics recycling program in New Brunswick.
A brand owner or its designated agent must submit an electronics stewardship plan for approval by the Board of Recycle NB. A brand owner or its agent must submit a stewardship plan by April 21, 2016.
 EPRA, in consultation with Brand Owners and industry, sets the Environmental Handling Fee (EHF) for each new electronic product. The EHF varies by product and province based on the cost of the EPRA recycling programs. The Environmental Handling Fee charged on new electronic products is not a tax and it is not collected by government. EPRA(Electronic Products Recycling Association) sets the Environmental Handling Fee for each new electronic product. Please consult the EPRA NB Website. Your registration with Recycle NB is completely separate from your registration with EPRA.

Brand owners are required by law to register with Recycle NB. You will have a Recycle NB registration number that confirms your company is registered and meeting its obligations under the Designated Materials Regulation. There is no registration fee.

Your EPRA registration is required by EPRA and is necessary for brand owners to make reports and remittances. The EPRA registration is for the purposes of the Association. It will be the number you will use in your regular transactions with EPRA.
